Chicago Music, Inc™ MAY TERMINATE YOUR SERVICE WITHOUT NOTICE FOR FAILING TO ABIDE BY THESE TERMS.

1. EXPLANATION AND CHARGING POLICY:
We offer access to a variety of music oriented content (the ''Service''). Certain parts of the Service are free and certain parts of the service require that you set up an account. You may generally visit without registering with the Service. Subject to the policies of the site you may be able to listen to music samples without registering with the Service.

2. YOUR RIGHTS:

Failure to comply with this provision (including, without limitation, falsification of any Registration Data) may, at our option, result in immediate suspension or termination of your right to access and use the Service without refund of any sums you may have paid as a subscriber.
You agree to notify us promptly, following subscription help instructions, in the event of any known or suspected unauthorized use of your subscription, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your account information.

You agree not to use any trademarks, service marks, names, logos, or other identifiers of Chicago Music, Inc™ or its employees, licensors, independent contractors, providers and affiliates (collectively, ''Affiliates'') without our prior written permission. In addition, you may not use our trademarks:
(a) in, as, or as part of, your own trademarks or those of any third parties;
(b) to identify products or services that are not those of Chicago Music, Inc™;
(c) in a manner likely to cause confusion; or
(d) in a manner that implies inaccurately that Chicago Music, Inc™ sponsors or endorses or is otherwise connected with your own activities, products and services or those of third parties.

Chicago Music, Inc and other related marks used on this Service, belong to us or our partners.

5. ''OPT-IN'' FOR SPECIAL NOTICES:
Chicago Music, Inc™ may periodically make special offers or communications to Subscribers to the Service. If you would like to receive such offers or communications, you may ''Opt-In''. If you change your mind at any time, you can reverse your option.

6. YOUR RESPONSIBILITY:
YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING THE SECURITY OF ANY ACCOUNT YOU USE TO ACCESS THE SERVICE AND AGREE THAT WE WILL HAVE NO OBLIGATIONS WITH REGARD THERETO. You agree not to assign, transfer or sublicense your rights as a user to the Service.

7. YOUR VISIT TO CHICAGO MUSIC, INC.com
Only you are permitted to use your account. You are responsible for all uses. Only one computer may be connected to our system at any one time with one account. Additionally, to the extent we are technologically able, we do not permit our site to be accessed by more than three (5) different computers using the same account within any twenty-four (24) hour period.

YOU ACKNOWLEDGE THAT ANY RELIANCE UPON ANY ADVICE, OPINION, STATEMENT, OR OTHER INFORMATION DISPLAYED OR DISTRIBUTED THROUGH THE SERVICE IS AT YOUR SOLE RISK. YOU ACKNOWLEDGE AND AGREE THAT CHICAGO MUSIC, INC IS NOT RESPONSIBLE FOR ANY MATERIALS POSTED BY USERS OF THE SERVICE. PRIOR TO MAKING ANY DECISIONS BASED ON INFORMATION POSTED ON THE SERVICE, YOU ARE ADVISED TO VERIFY THE INFORMATION. NEITHER CHICAGO MUSIC, INC NOR ITS AFFILIATES SHALL HAVE ANY LIABILITY ARISING FROM YOUR ACTS OR DECISIONS BASED UPON THE INFORMATION PROVIDED ON THE SERVICE!

10. AGE RESTRICTIONS:
You represent and warrant to Chicago Music, Inc that you are at least eighteen (18) years old and that you possess the legal right and ability to enter into this Agreement and to use the Service in accordance with this Agreement.

11. INDEMNIFICATION:
You hereby agree to indemnify, defend and hold harmless Chicago Music, Inc from and against any and all liability and costs.

12. DISCLAIMER OF WARRANTY:
EXCEPT AS EXPRESSLY SET FORTH HEREIN, THE SERVICE (INCLUDING ALL CONTENT, SOFTWARE, FUNCTIONS, SERVICES, MATERIALS AND INFORMATION MADE AVAILABLE THEREON OR ACCESSED BY MEANS THEREOF) ARE PROVIDED AS IS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, COMPATIBILITY, SECURITY, ACCURACY, OR NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, Chicago Music, Inc™ MAKE NO WARRANTIES AND SHALL NOT BE LIABLE FOR THE USE OF THE SERVICE UNDER ANY CIRCUMSTANCES Chicago Music, Inc™ WILL MAKE COMMERCIALLY REASONABLE EFFORTS TO MAINTAIN THE SERVICE FREE OF VIRUSES, WORMS, TROJAN HORSES, AND ACTIVE X MALICIOUS CODE.

13. LIMITATION OF LIABILITY:
USE OF THE SERVICE IS AT YOUR OWN RISK. YOU ASSUME FULL RESPONSIBILITY AND RISK OF LOSS RESULTING FROM YOUR DOWNLOADING AND/OR USE OF FILES, INFORMATION, COMMUNICATIONS, CONTENT, OR OTHER MATERIAL.

14. TERMINATION:
In addition to any other rights of the parties set forth herein, either you or Chicago Music, Inc may cancel or terminate your access to the Service. If Chicago Music, Inc terminates these Terms of Service based on a breach of any portion of these Terms of Service, Chicago Music, Inc reserves the right to refuse to provide use and/or access to any Services to you in the future. You acknowledge that Chicago Music, Inc shall not be liable to you or any third party for any termination of your access to this Service.

15. MODIFICATIONS:
(a) To the Agreement: Chicago Music, Inc™ has the right to modify these Terms of Service and any policies affecting the Service.

16. OTHER BUSINESSES
Chicago Music, Inc™ does not assume any responsibility or liability for the actions, product, and content of any third parties.

17. VIOLATIONS:
If you see content that you believe violates these Terms of Service, please notify us at trent@Chicagotheband.com
If you believe that your work has been copied and is accessible on this Service in a way that constitutes copyright infringement, you may notify us at the same address.

18. GENERAL:
These Terms of Service constitute the entire agreement between you and Chicago Music, Inc with respect to the Service and supersede all prior agreements between you and Chicago Music, Inc™ with respect to the Service. Failure by Chicago Music, Inc to enforce any provision of these Terms of Service shall not be construed as a waiver of any provision or right. Please do not suggest or encourage illegal activity. Chicago Music, Inc™ will cooperate with law enforcement officials as appropriate.
